Draft — not yet published. Version: draft (not yet assigned) · Effective date: not yet in effect. Once published, this page will display a version identifier and effective date here, consistent with the Changes to These Terms section below — the version/date a Client accepts is the version that governs their engagement.
These Service Terms constitute a binding agreement between [LEGAL CONTRACTING PARTY / DBA STATUS — TO BE CONFIRMED] ("MomHELP," "we," "us," or "our") and the person purchasing or receiving services ("Client," "you," or "your"). They describe how billing, scheduling, and service delivery work for clients of MomHELP and apply to all services purchased through our website, by phone, or by email. For services covering home access, liability, and other agreement-level matters, see the MomHELP Client Service Agreement, which every client signs before service begins.
How to use this page: These are the full legal terms for MomHELP services — every word here is the actual agreement, not a summary. The table of contents below groups the sections by topic so you can find what you're looking for quickly, and jump back here any time.
Hourly Help and package service time carry a 1-hour minimum and are billed in 15-minute increments after the first hour. One qualifying Quick Task is priced separately as described below; work beyond one Quick Task moves to Hourly Help unless another specifically priced service applies.
Travel & mileage. MomHELP does not charge service time or mileage for the initial trip to a client or first task location when it is within 10 miles of MomHELP's Natick service base. If the first destination is more than 10 miles from the service base, any additional travel charge is agreed upon with the client in advance, not billed after the fact. Once work begins, travel between locations required to complete the client's list — for example, driving from one stop to the next — is billed as service time, since MomHELP is actively performing the client's work during that time. Mileage driven between stops is reimbursed by the client at the then-current IRS standard business mileage rate. Actual client-related parking and tolls are reimbursable expenses. If the final stop of a job is the client's home (e.g., a delivery), that leg of the trip is billable service time and mileage; if the final task ends elsewhere and MomHELP does not return to the client's home, the trip home is not billed.
General pricing described on MomHELP's website or other marketing materials is provided for reference and is subject to change. If the pricing, scope, or terms stated in an individually issued written quote or service confirmation for a specific job differ from MomHELP's general website pricing or marketing materials, the individually issued quote or service confirmation controls for that job. Where no individual quote or service confirmation addresses a particular matter, these Service Terms control.
Time estimates are provided in good faith but are not guarantees. If MomHELP reasonably expects that a task will require more time than originally estimated, MomHELP will notify the Client as soon as reasonably practical and, when possible, obtain approval before continuing substantially beyond the estimate.
MomHELP may use up to one additional 15-minute billing increment when reasonably necessary to complete work already in progress or reach a reasonable stopping point. By accepting these Terms, the Client authorizes and agrees to pay for that additional increment when used under this provision. If additional time beyond that is expected and the Client cannot reasonably be reached, MomHELP will ordinarily pause or discontinue the task at a reasonable stopping point. MomHELP may take reasonable additional action when necessary to protect persons or property, avoid creating an unsafe condition, or address circumstances in which work cannot reasonably be left incomplete.
Time during which MomHELP is required to remain available or at a particular location in connection with a Client's requested service is considered service time, including reasonable waiting time associated with telephone calls, lines, appointments, deliveries, service providers, orders, or similar tasks. If MomHELP is free to leave or otherwise discontinue work while awaiting a later event, service time will ordinarily pause until work resumes. Time spent performing another task for the same Client during a waiting period will not be counted twice.
Planning & Estimate. Requests that require MomHELP to determine priorities, research options, combine work, identify providers, or decide the best approach begin with a $50 Planning & Estimate payment. That payment covers up to one hour of initial planning and a recommended plan for the first five service hours.
Support Packages. MomHELP currently offers 5-Hour Support ($250) and 10-Hour Support ($500). If a Client purchases a package after paying for Planning & Estimate, the full $50 planning payment is applied to the package price and does not reduce the package's service hours. The 5-Hour Support package therefore has $200 remaining after the planning payment; the 10-Hour Support package has $450 remaining. The 10-Hour Support package also includes up to one additional planning hour at no additional cost; neither planning hour reduces the ten service hours.
Package service hours are a bank of MomHELP service time, not a fixed number of appointments or visits. Service sessions carry a one-hour minimum and are tracked in 15-minute increments thereafter. Unused package service hours remain valid for 6 months from the date of package purchase; hours not used within that period expire and are not transferable, subject to the refund provisions below and applicable law.
Quick Task. A Quick Task is one brief, local, execution-ready errand for which the Client provides the destination, timing, items, and instructions needed to perform the work without MomHELP research, comparison, prioritising, or planning. One qualifying Quick Task is $20. Work beyond one qualifying Quick Task moves to Hourly Help at the then-current hourly rate unless another specifically priced service applies. Quick Task eligibility depends on scope, location, expected time, and whether the single task is fully ready to execute.
If a Quick Task materially expands, MomHELP will notify the Client before converting it to Hourly Help. No conversion occurs without the Client's approval, and any Quick Task payment already made is credited toward the approved hourly charge.
Buy Nothing service. MomHELP's separately priced Buy Nothing service is $20 for 1–5 items or $40 for 6–10 items and may include pickup, posting, managing interest and no-shows, reposting when needed, and charity drop-off if items are not claimed. Furniture is not included in this service.
Priority or same-day service is subject to availability and may carry a $15 surcharge when disclosed to and accepted by the Client in advance. MomHELP may waive the surcharge at its discretion.
A Support Package may be cancelled for a full refund within 7 days of package purchase provided no package service hours have been used and no package-included additional planning has been performed. The separate $50 Planning & Estimate payment covers planning actually performed and is not converted into a refundable deposit merely because the Client later elects not to purchase or continue with a package. When a package is purchased, that $50 is applied to the package price as described above.
Once package services have begun, package purchases are nonrefundable except in the following circumstances: if MomHELP ends the service relationship for reasons other than the Client's misconduct or safety concerns, MomHELP will refund the value of unused package service hours; MomHELP may issue a full or partial refund at its discretion in exceptional circumstances; or applicable law requires a refund. Unused service hours that reach the end of the package's six-month validity period are not refundable, except where required by law.
For Quick Tasks: if the Client cancels before MomHELP has materially begun performing the task, any Quick Task payment is fully refunded. Once MomHELP has materially begun performing the task, the payment is nonrefundable except where MomHELP is unable to complete the task for reasons attributable to MomHELP. If MomHELP is unable to complete a Quick Task for reasons attributable to MomHELP after work has materially begun, MomHELP may refund the Quick Task payment in whole or in part as appropriate to the work performed. No refund is owed where completion is prevented by circumstances attributable to the Client — for example, inaccurate information, unavailable access, or the Client's cancellation after MomHELP has materially begun the task.
MomHELP may make client-related purchases of up to $50 without additional approval, provided they are reasonably necessary to complete the agreed work. Any purchase expected to exceed $50 requires client approval first, unless the client has authorized a different spending limit for that assignment. Purchases are reimbursed at actual cost with no MomHELP markup, and receipts are provided when reasonably available. MomHELP is not required to advance substantial funds on a client's behalf and does not routinely hold clients' cards, PINs, banking credentials, or similar payment information.
MomHELP does not ordinarily charge cancellation or rescheduling fees. Clients are asked to provide as much advance notice as reasonably possible when plans change. Repeated late cancellations, no-shows, or inability to access the service location may result in MomHELP declining or limiting future bookings. This provision does not affect billing for work already performed, travel already undertaken, or expenses already incurred on a client's behalf prior to a cancellation — see Billing & Time and Expenses & Purchases, above.
MomHELP may refer clients to independent, third-party service providers (e.g., contractors, cleaners, repair technicians). MomHELP does not employ these providers and is not responsible for the quality, safety, or outcome of their work. Clients may choose to work with a referred provider directly at no charge from MomHELP, or may ask MomHELP to coordinate the engagement, which is billed at our standard hourly rate. Any amounts owed to the third-party provider are separate from and in addition to MomHELP's fees.
With the Client's express authorization, MomHELP may enter and perform agreed services in the Client's home or other authorized property while the Client is not present.
Where reasonably practical, temporary or individually assigned access codes are preferred. If the Client provides MomHELP with a physical key, MomHELP will take reasonable measures to store it securely and will not label it with the Client's full name or property address. Keys, access codes, alarm information, and other security information will be used only as reasonably necessary to perform authorized services and will not be shared with another person unless the Client has authorized that person's access.
MomHELP will not knowingly admit another person to the Client's property without the Client's authorization, except where reasonably necessary in an emergency.
When property access is no longer required, physical keys will be returned to the Client and stored access information will be deleted when it is no longer reasonably necessary for service, recordkeeping, security, or legal purposes.
MomHELP will notify the Client promptly upon becoming aware that a key has been lost or that access or security information may have been compromised.
MomHELP may decline to enter, discontinue services, or leave a property when MomHELP reasonably believes conditions present a safety or security risk, including but not limited to threatening persons, unsecured or aggressive animals, hazardous conditions, suspected illegal activity, or other circumstances that reasonably make continued presence unsafe.
Clients must disclose in advance any animals at the service location that are known to present behavioral, access, or safety concerns and must provide any information reasonably necessary for MomHELP to enter and perform services safely.
Clients are responsible for appropriately securing animals when reasonably necessary to permit safe performance of services. MomHELP may decline to enter, suspend services, or leave a property if an animal, person, environmental condition, or other circumstance reasonably appears to present a safety risk or materially prevents the agreed services from being performed.
Clients are responsible for disclosing known hazards and providing reasonably safe access to areas in which services are to be performed.
MomHELP is happy to help families, including in homes where children or other household members are present. Unless a service has been specifically agreed to in writing, MomHELP does not provide childcare, babysitting, personal care, supervision, or custodial care and does not assume responsibility for individuals who may be present while services are being performed.
When a child or another person requires supervision or care, the Client is responsible for ensuring that an appropriate caregiver is present and remains responsible for that individual throughout the MomHELP service.
If MomHELP reasonably believes that a person or property is experiencing an immediate health, safety, or other emergency requiring emergency assistance, MomHELP may contact 911 or other appropriate emergency services immediately, without first attempting to contact the Client or any emergency contact. After contacting emergency services, and when reasonably practicable, MomHELP will attempt to notify the Client and then the Client's designated emergency contact(s) in the order specified in the Client Service Agreement.
If circumstances present a concern but MomHELP does not reasonably believe immediate emergency assistance is required, MomHELP may first attempt to contact the Client or designated emergency contact, as appropriate under the circumstances.
MomHELP does not provide medical assessment, diagnosis, treatment, or emergency medical services and has no authority, solely by virtue of providing MomHELP services, to make healthcare decisions or consent to medical treatment on behalf of the Client or another person. Nothing in these Terms requires MomHELP to place itself or another person in danger.
MomHELP provides non-medical personal, household, administrative, errand, research, organizational, and coordination assistance. MomHELP does not perform work requiring a professional license, certification, specialized clinical judgment, or skills/equipment MomHELP does not possess, and may decline any task that is illegal, unsafe, inappropriate, or outside the agreed scope of services.
Without limiting the above, MomHELP does not provide:
Where a task falls outside MomHELP's services, MomHELP may assist with the logistics surrounding it — for example, identifying and coordinating an appropriately licensed or qualified provider — even where MomHELP does not perform the underlying work itself.
MomHELP will take reasonable measures to protect nonpublic information learned or received in connection with providing services and will use such information only as reasonably necessary to provide requested services, communicate with the Client, maintain appropriate business records, protect legitimate legal or business interests, or comply with applicable law.
MomHELP will not sell Client information. MomHELP may disclose information when authorized by the Client, when reasonably necessary to coordinate or perform requested services, when reasonably necessary to address an emergency or safety concern, or when required or permitted by law.
MomHELP will seek to limit information shared with third-party service providers to what is reasonably necessary for the requested task.
MomHELP will not use identifiable Client information, photographs, recordings, testimonials, or details about Client services for advertising or promotional purposes without the Client's permission.
MomHELP's services routinely involve driving — for example, running errands, making deliveries, and traveling between stops on a Client's behalf — and nothing in these Terms limits that. MomHELP does not, however, transport Clients or other people as passengers. Passenger transportation is outside the scope of these Terms unless expressly agreed in a separate written agreement.
The Client agrees to: provide accurate and complete information reasonably necessary for MomHELP to perform requested services; give lawful instructions; have the authority to authorize the work, purchases, and access requested; maintain a reasonably safe environment for MomHELP personnel; disclose known hazards, animals, or access restrictions relevant to the service location; be reasonably available for approvals or communications necessary to complete the work; maintain sufficient funds or reimbursement arrangements for purchases made on the Client's behalf; and comply with the reasonable rules of any third party involved in a requested service (for example, a store, provider, or venue).
Either party may end the ongoing service relationship at any time by notifying the other. MomHELP may also terminate service immediately, including mid-engagement, where the Client's conduct is unsafe, unlawful, abusive, threatening, or fraudulent, involves nonpayment, or involves materially misleading information provided to MomHELP. Termination does not relieve the Client of the obligation to pay for services already performed, expenses already incurred, or amounts otherwise already owed as of the termination date.
Liability terms — including any limitation of liability, disclaimer of warranties, and related provisions — are still being drafted with Massachusetts counsel and are not yet included in these Service Terms. Until this section is finalized and published, no such limitation is in effect, and applicable Massachusetts law governs liability between the parties.
These Service Terms, and any dispute arising out of or relating to them or to MomHELP's services, are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. Any legal action or proceeding arising out of or relating to these Terms or MomHELP's services will be brought in the state or federal courts located in Middlesex County, Massachusetts, and each party consents to the jurisdiction of those courts for that purpose.
By using MomHELP's services, the Client agrees that email, text messages, electronic service confirmations, and other electronic communications satisfy any requirement that a communication, notice, approval, or agreement be in writing, to the fullest extent permitted by law. The Client further agrees that electronic acceptance — for example, checking a box, clicking to accept, or replying to confirm — satisfies any requirement for a signature, to the extent permitted by applicable law. A Client may withdraw this consent for future communications by contacting MomHELP at HireMomHELP@gmail.com, though doing so may limit MomHELP's ability to provide services that depend on electronic scheduling, confirmations, or payment.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be interpreted to reflect the parties' original intent as closely as permitted by law.
No Waiver. MomHELP's failure to enforce any provision of these Terms is not a waiver of that provision or of MomHELP's right to enforce it later.
Assignment. The Client may not assign or transfer rights or obligations under these Terms without MomHELP's written consent. MomHELP may assign these Terms in connection with a sale, transfer, or reorganization of its business, provided the assignee agrees to honor these Terms.
Entire Agreement. These Service Terms, together with the MomHELP Client Service Agreement and any applicable written service authorization, quote, or service confirmation, constitute the agreement between MomHELP and the Client concerning MomHELP's services, and supersede any prior or contemporaneous understandings on that subject.
Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
Modifications to an Individual Engagement. Changes to the scope, pricing, or terms of a specific service engagement must be agreed between MomHELP and the Client in writing (including by email or text) before they take effect. This is separate from MomHELP's ability to update these Service Terms generally, as described below.
We may update these Service Terms from time to time. Material changes will be posted with an updated effective date and, where reasonably practicable, communicated in advance to clients with an active Support Package or upcoming scheduled service. Updates generally apply to services purchased or scheduled on or after the effective date and do not retroactively change the terms of a transaction already completed.
